Sony did protect their information. It may not have been encrypted, but it was definatly protected. It was in a closed network in which only some Sony employees had access to.
The biggest infringement is the hackers, unlawfully gaining access to protected networks, and unlawfully recording users financial details without the users written concent. Sony is fully protected here, in terms of Law anyway. Their userbase will probably run them into the ground.
